Workers’ Compensation Protection Legislation Becomes Law

The Illinois Senate and Senate recently voted overwhelmingly to override the Governor's veto of SB 904, which provides workers' compensation providers the ability to collect on unpaid claims from insurers.

The bill, which will now become state law, allows physicians to collect 1% interest on late claims by filing a claim with the relevant circuit court. This corrects an existing loophole used by insurers by giving providers a legal mechanism to pursue and collect accrued interest. The law will also require workers' compensation insurers to provide detailed explanations of their benefits to medical offices, and to use electronic billing consistent with state law.
